Well today is the second day of the puliminary court hearing for my uncles Juan and Kiko…From my point of view I see it this way, The boys who shot my uncles are named Jose Nogales [15] and Carlos Carrasco [19] and my family and I are the good team and the boys are the Bad team and while in court and with all of our attorneys representing our side, are presenting all the our evidence we have, to keep the bad guys in jail for life. And so far from yesterday March 11, 2008 to today March 12, 2008 our team is winning, and from what I hear when my uncle Rene went up to testify yesterday he was stuttering and the people who were asking questions were pretty much asking the same question over and over but would re-word it so my uncle changed up his answer because he fell for their scandalous tricks which made it look like he was lying or confused about what happened the night of the day my uncles got shot on July 8, 2008. But When you loose a sibling and were there when you lost them and it happened the way my uncles died then you try not to remember that day as much as you can because its not really something you want to remember…..Right? I would think so and so do my Uncle Rene and Aunt Sara. There is a time limit that my family is in the court room and every so often they take a break and because I'm under the age of 18 I have to wait outside the room. So when they get a break they come out and explain what’s happening in the court room. Yesterday they basically told me that Jose or b.k.a ‘’Pekas’’ [the younger one] has had 22 incidents (since he was 12) were he did something bad before this happened and .?.?. parrol, he also has 2 tattoos on his forearms and one on the webbing between his thumb and index finger that say P.H[Paradise Hills: what he bangs] and the other saying V.P.H[meaning Varrio Paradise Hills] and his mom had the nerve to say ‘’oh my poor baby my little innocent boy he's not guilty’’, he also has been associated with the Paradise Hills gang since he was 12!! I and from outside the courtroom in the hallway I could see what the younger boy looks like but not the older one. I also found out that the 15 year old lives on Doriana street like 3 blocks from my house, behind the liquor store and the mariners village apartments…. The older boy Carlos or b.k.a ‘’Stalker or stalks’’ had shot up the Chula Vista mall in May of 2007 and also was seen with four other guys in the alley (behind the elementary school Robert E. Lee) and shot a boy in the abdomen in June of 2007 as well. I know that I have seen the younger one before, because of where he lives I think we went to the same middle school, Alexander Gram Bell Junior High School. I also know a girl who I went to elementary school and middle school with named Serina and she knows most of the P.H gang members and hangs around a majority of them and I guess it just makes me a little sick that I have friends and people who know people and they know me and in this twisted little way we are all conneceted and its hurtful to know that the people you know hang and around with know the kids who shoot people and kill innocent bi-sandards... We are asking to give Mr. Carrasco[19] the death penalty even though he didnt shoot he was an accessory in the DOUBLE homicide of my uncles Frank (kiko) and John(juan) and as for Mr.Nogales[15] when he did the shooting he was only 14 which means he turned 15 in juvey, and we can not try him as an adult so the District attorney had told my family and I that Mr.Nogales will get chared with 50 to life in prison but it was a DOUBLE homicide so hes getting double the time which is 100 years in prison.Well this is my short and summed up point of view on this now heres what really happened................
Preliminary Hearing In the case of Carlos Carrasco and Jose NogalesHis Honor Judge John S. Einhorn Presiding Superior Court 58March 11th, 2008 at approximately 9:30 AM the Preliminary procedure in the State VS Carrasco & Nogales began with an eyewitness from a shooting which occurred June 22nd, 2007, on Manos Street in Paradise Hills San Diego. The witness is referred to as “Jane Roe”. Ms. Roe identifies the older male in the blue jump suit as one of the perpetrators, in the alleyway of the apartment complex where the shooting occurred. Ms. Roe also points out this same male as well as another male out of a series of photographs shown by an investigating detective. Ms. Roe is then asked to draw where she was in accordance with the perpetrators at the time of the alleged shooting. Ms. Roe then proceeds to draw her location and proximity to the perpetrators. She then goes on to describe the clothing and facial features of the males in the alleyway. Ms. Roe then goes on to describe a weapon that was in the waistband of one of the young men who were running southbound out of the alleyway. Ms. Roe then notices a victim walking towards her holding his abdomen calling for a female who resides in the complex. During the hearing a Detective Sherman recalls responding to the assault at the Manos Street alleyway. Sherman reports that he and his partner Penerelli, as well as Officer Annis proceed in the collection of evidence at the Manos scene. Where bullistics 9millameter 45 caliber shell casing was recovered, and sent to the crime scene lab to be logged and tagged with a case number. And will have relevance further on in the discovery of evidence. Next a female detective was brought in to read the statement of Miss Blanca Avalos.This Detective recounts what Ms. Avalos seen and described the evening of the double homicide. Following the questioning of Miss Avalos, she was taken in an unmarked police vehicle to a curbside identification of Mr. Carrasco, which took place at Woodman and Alta View. Where Mr. Carrasco was driving the vehicle that is described by the eyewitness, Miss Avalos.Detective Conley was sworn in to give the written statement of Mr. Sammy Landrey, a second eyewitness to the shootings of Frank and John Perez. Detective Conley then proceeded to give the recount of Sammy’s statement. Following Sammy’s statement, he too was taken to do a curbside identification on Woodman and Alta View of Mr. Carrasco and the vehicle, a white, late 1990’s model Chevy/GMC pick up truck. Sammy states that the goat-t of the perpetrator was similar to that of Mr. Carrasco’s.Mr. Rene Perez, brother to the 2 victims was called, and sworn in to give his account of the events that unfolded the evening of July 8th, 2007. Rene tells how Frank mentions that the truck has driven past the house and was making a 2nd come around, and Frank felt uneasy about this. Rene then proceeds to state that the truck pulled up and stopped in front of the Perez Family home at 619 Sawtelle Avenue, heading southbound. Rene is then asked to describe his location and proximity to the vehicle on the street, and the location of the vehicle’s location in proximity to the house. He is then questioned about the events that led up to the shootings. Rene states that the drive of the vehicle begins to shout of “P.H. mother fuckers!” “Where are you from?” “Paradise Hills!” Rene says that Frank then tells the driver to “get the hell out of here” “go home, don’t bring that shit here”. Rene then claims that he noticed the passenger side door of the truck open and sees a head coming out and then proceeds to throw himself to the ground, fearing that there is something about to happen. Rene then tells the court he hears gunshots, 5 to 6 rounds get popped off, and he stayed down until he hears the truck drive away. And then hears Mr. Landrey (Sammy) and Mr. Chavez (Pete) shouting, “Frank is down!” “John’s hurt he’s bleeding!!” he then proceeds to render aid to his brother Frank and then to John. We we’re then given a 15 minute recess.The defense attorneys then begin to question Rene on his ability to give an accurate description of the vehicle as well as the driver. Questioning, “had Mr. Perez been drinking?” How could he see how many people were in the vehicle? Was the dome light on? Rene states that the back window of the truck was tinted, and therefore he cannot give an accurate count of how many people were in the vehicle, but knows for a fact that there was a driver and a passenger. Mr. Perez was also questioned as to why he had been at his parent’s home that evening. During the investigation on the night of the incident, Rene was also taken to conduct a curbside identification of Mr. Carrasco and the vehicle, where he gave a positive I.D. to the vehicle and a possible I.D. to Mr. Carrasco, as the lighting was not the same as on Sawtelle. He did however recall that the drivers’ goat-t was distinctive, and very similar to that of Mr. Carrasco’s. Mr. Perez was asked, was the same man he identified in the early morning hours of July 8th, 2007 in the courtroom now? Rene responded, “I see that guys sitting right there in the blue prison jumpsuit.” The Judge then tells the court to note that Mr. Perez has just identified Mr. Carlos Carrasco. Sergeant Dave Johnson is called to give his testimony. Sergeant Johnson recounts the interview he and Detective Holden had with a Ms. Adriana Orosco, friend to Mr. Carrasco and Mr. Nogales. Ms. Orosco claims that she was out with Carrasco, Nogales and another female, Janelle Greed, at Collier Park in La Mesa the day of July 7th, 2007. She states that after leaving the park they 4 go to eat pizza. After finishing dinner they 4 continue there evening by going to a party in Spring Valley at the apartment of a friend, Jamie Dominguez. During the interview Ms. Orosco is asked whose vehicle was she in? Adriana claims that the white full sized pick up belongs to her friend Janelle’s mother. When asked who was driving the vehicle, she states that Carlos Carrasco was the driver that evening. While at the party she says that Carrasco and Alex Limon leave and don’t return for a while. At about midnight Carrasco, Nogales, and Greed take Orosco home.When asking Ms. Orosco if there was wood in the bed of the truck she states “yes”, as the 2 couples were to have a bon fire but opted to go to the party instead. The interview with Adriana Orosco took place at her parents’ home on July 24th 2007.We were then given a one hour and thirty minutes for lunch.Detective Sherman a 10 year active officer in the San Diego Police Department was called to the stand to give his recount of the shooting on Manos Street. Sherman recalls his interview with Armando Espinoza, the victim who was shot in the abdomen On June 22nd 2007. Mr. Espinoza states that as he sat in his vehicle waiting for a female friend to come out, he noticed 2 Hispanic males walking northbound in the alleyway, and was met by 2 other Hispanic males. Mr. Espinosa, feeling he had waited long enough for his friend decided to go and see what was taking her so long. As he exited his vehicle he had to cross paths with the 4 youths, who then proceeded to ask, “Where are you from?” Armando said to the young men, “I don’t bang.” When a young man in a Black baseball cap with a black shirt and blue jeans, pulls out a gun and shoots Mr. Espinoza. The 4 youth then turn and run southbound out of the alleyway. (As stated earlier by Jane Roe) In a photo line up of various known Paradise Hills gang members, Mr. Espinoza identifies both Mr. Carrasco and Mr. Nogales as 2 of the males in the alleyway. Detective Sherman and his partner detective Penerelli conducted the interview with Armando 48 hours after the attack. Next Detective Hobbs, who has 18 years on the San Diego Police Force was sworn in to give is recount of July 8th 2007. Detective Hobbs was the officer who transported Mr. Rene Perez to do the curbside identification. He drove an unmarked police vehicle and was parked in the Jack in the box parking lot on Alta View, waiting his turn to take the eyewitness to view the alleged perpetrator, while in the parking lot he recalls explaining to Mr. Perez verbatim a check list of how to and not to judge his response. Detective Hobbs also re-states written notes of an interview with Miss Blanca Avalos. Miss Avalos claims to have seen the truck drive northbound, make a u-turn and return southbound and stop in front of the Perez home on Sawtelle. Blanca also states she heard the gang challenge being shouted by the driver and within seconds hears 5 to 6 gun shots. Miss Avalos described the driver and says that she could only see the driver and a passenger in the vehicle. These statements were given on July 8th, 2007.Ms. Jennifer Sanders a Forensics Expert with the San Diego Police Department is called to give testimony. Ms. Sanders is on the scene at 619 Sawtelle on July 8th, 2007. Ms. Sanders states she is gloved and is assigned to collect bullet fragments and shell casings from the location. She claims she collects 2 9millameter casings on the east side of Sawtelle Street, which she has numbered 16 and 19 in the evidence log. She also locates bullet fragments in the house, which she proceeds to number 10, 13, and 18 and logs them in to evidence property tag # 021213.Jennifer also processed the gun, which was given to her by detective Sherman. She processed for prints, DNA, and GSR. In doing so she used a procedure called “super gluing” and she also used black powder to lift any prints. She swabbed for DNA and the swabs were put in the freezer tagged FS24A. As Jennifer lifted prints she photographed and lifted them, and sent them to the “Print Unit” for further examination. Ms. Sanders also processed the White Chevy Silverado and found 62 prints. On the outside of the truck, on the passenger side of the bed Ms. Sanders recovered 3 prints she numbered them 35, 38, and 40. While processing the trucks interior she found a blue ball cap with 1608 embroidered on the front, and numbered that 61, and logged that into evidence.Ms. Sanders received 2 GSR kits from Detective Sherman, which she numbered 21 – Carlos Carrasco and 22 - Jose Nogales, which were also logged into evidence. Jennifer then logged into evidence a DNA kit for Mr. Carrasco Item #71, which was done by Detective Munoz. Jennifer Sanders went to The San Diego Crime Lab Studio to do a DNA kit on Mr. Nogales, item #25.A Mr. Steven Cordes, San Diego Police Department Forensics Science Lab Specialist was sworn in to give his testimony on the GSR kits, which he examined.*Property tag #21 (7241) where he found 1 particle of GSR on the left hand of Mr. Carrasco. **Property tag #22 (7291) where he found 2 particles of GSR on the right hand of Mr. Carrasco. When asked by the defense attorney how long GSR stays on someones hands, Mr. Cordes states anywhere from 6 to 7 hours. Mr. Cordes also states that there is more GSR from a revolver as apposed to a semi-automatic. Ms. Mary Jane Flowers, a criminalist with San Diego Police Department Forensics Lab – Fire Arms Department. Ms. Flowers was sworn in an asked to describe her job pertaining to the case at hand. When Ms. Flowers received the bullets from the Sawtelle shooting she placed them in IBIS (a federal search to identify bullet striation) they came back a 100% match to the bullets found at the Manos Street shooting. The gun is a 9-millimeter Rouger, a Tan Foglio T275 Semi-automatic Pistol. This gun is the gun that is in evidence. The test was July 23rd, 2007 and Ms. Flowers report was written on July 31st, 2007.District Attorney Frank Johnson re-calls Detective Sherman to the stand. Sherman, a Detective in the San Diego Street Gang Unit, Unit 1 is asked his job. Detective Sherman is has been involved in 12 cases regarding the Paradise Hills Street Gang since his start in the unit in 2003. Detective Sherman has specific knowledge of Carlos Carrasco since May 19th of 2007. Detective Sherman was investigating a shooting at the Chula Vista Mall involving Mr. Carrasco. When Sherman talks with Carrasco a second time, Carrasco is arrested after the SDPD Helicopter finds him hiding under a tree, for running from a crime. Sherman meets with Mr. Carrasco 2 other times and knows of several reports where Carrasco is named and involved. Although Mr. Carrasco has not claimed that he is a member of the Paradise Hills Street Gang, he is known to have friends and connections with various members of P.H. According to various sources Mr. Carrasco is known on the street by “Stalker” or “Stalks”. Detective Sherman knows Jose Nogales and has had personal contact with him on and off over the past 2 years. Sherman had investigated crimes where Mr. Nogales is named or associated with. Nogales is known on the streets by “Pecas” or “Pekas”. Jose has been in the Paradise Hills Gang since the age of 12 and was documented in 2004 by Detective Todd Bassett. Jose is tattooed on both forearms, P on the right forearm and H on the left forearm. He also has a tattoo on the web of his thumb and index finger, “V.P.H.” His older brother is also a known gang member of Paradise Hills. Mr. Nogales has had 22 contacts to various crimes claiming Paradise Hills. The detectives have found him on several probation searches deep into gang life. Detective Sherman, a gang specialist was asked why young men commit these acts of violence. Sherman responds that there may be benefits in the ranks of the gang. Such as status, respect, recognition, or simply to build self esteem. They may feel as if they are sending a message to their enemies. At this point Judge Einhorn dismisses court for the day. And will reconvene Wednesday March 12th 2007 at 9AM.
Well there you have it people now you are filled in on whats going on in my life and what I'm really focused on. The TRIAL will carry on next month... oh and just to everyone who cares to read this, my uncles were NOT gang bangers and they so much more life ahead of them there were both grown men and were shot and killed for NO reason....
